Out with the Old - Ohio’s Oldest Refrigerator Contest Terms and Conditions
Contest Description: NO PURCHASE NECESSARY TO ENTER OR WIN. Open to legal residents of the U.S., age 21 or over, who currently maintain an Ohio residential electric service account with one of the participating program sponsors (AEP Ohio, Dayton Power and Light, Duke Energy Ohio, EfficiencySmart, First Energy Ohio, and the City of Westerville). The contest will recognize and reward the customer of each participating program sponsor who turns in the oldest qualifying refrigerator or freezer (appliance) within each sponsor’s service area and the customer with the oldest appliance turned in statewide. The contest will run from May 1 to July 31, 2013. At the end of the contest period, each sponsor will recognize individual sponsor territory winners and the administrator and the sponsor, in whose territory the winner resides, will recognize the statewide winner.
The contest is administered by JACO Environmental, Inc (JACO or administrator). JACO is administering energy efficiency appliance recycling programs for all the participating program sponsors and is one of the nation’s largest appliance recycling companies. JACO maintains 2 advanced appliance recycling centers in Ohio.
How to Enter, Qualifications, Eligibility – Schedule to recycle your old appliance through your participating program sponsor during the contest run time, May 1- July 31, 2013. All units will automatically be entered into the contest unless the program participant elects to opt out of the contest.
Customer’s units must meet the qualifications of the energy efficiency refrigerator recycling program. There are three qualifications:
- Units must be collected from a residential address with an active electric account of a participating utility.
- Units must electrically powered and in working order.
- Units must be a minimum of 10 cubic feet and maximum of 30 cubic feet in internal dimensions to qualify for program participation. During the contest period, the minimum size will be reduced to 6 cubic feet for older, round-topped units that look like this:
All appliances collected during the contest period will be entered into the contest. Owners of winning entries will be required, as a condition of receiving the prize, to agree to terms regarding use of the units and their story for publicity purposes and to execute a release of liability for the program administrator and sponsors.
Employees, officers, directors and agents of the participating sponsors, and any of the sponsors parent companies, affiliates, subsidiaries, advertising, promotion and fulfillment agencies, their immediate family members and persons living in their same household, are not eligible to participate in the contest. Void where prohibited. All federal, state and local laws and regulations apply.
Determining the Winners – JACO will retain all the oldest appliances collected during the period at one of its two recycling facilities in Ohio and conduct research to determine the oldest ones. All the oldest units will be kept intact and available for examination, if needed, throughout the awards period and each will have detailed tracking information for the customer who provided the unit (account number, address, contact and unit collection information).
Award - The winners of each participating sponsor’s oldest appliance will be awarded a $250 gift card for ENERGY STAR® product purchases. The customer who turns in the oldest appliance statewide will get an additional $1,000 gift card for ENERGY STAR® products purchases.
General Conditions – The administrator reserves the right to halt the contest at any time due to situations beyond its control, such as strikes, acts of God, etc., or for any reason. Administrator reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the contest. Administrator reserves the right to cancel this contest at any time without obligation or prior notice. By entering, each participant agrees to be bound by these Official Terms and Conditions and the decisions of the administrator, which shall be final. Prize winners will be solely responsible for all applicable federal, state and local taxes on prizes; to the extent required by law, winners will receive an IRS Form 1099 for the retail value of the prize. Any prize not accepted by a winner will be forfeited and may be awarded to another contestant at the option of the administrator.
Limitations of Liability and Release - All entrants, as a condition of entry into the contest, agree to release, discharge, and hold harmless the administrator and participating program sponsors, from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may arise out of or relate to participating in any aspect of the contest, the receipt, ownership, use, misuse or possession of any prize awarded, or while preparing for, participating in or traveling to or from any prize-related activity, or for any typographical or other error in these Official Terms and Conditions or the announcement of offering of any prize.
